Simple Uncontested Divorce: The Least Expensive and Most Stress-Free Path to Divorce

A simple Uncontested Divorce is often the most straightforward and cost-effective solution for couples who agree on all key issues. This type of divorce is suitable for when there are no disputes regarding asset/debt division, child custody, parenting plan, child support, maintenance (alimony), and other matters.  No disputes means that these issues either do not exist, or they have been resolved in a settlement/separation agreement. Our firm specializes in handling uncontested divorces efficiently, ensuring that all necessary paperwork is accurately completed and filed.

By choosing this path, you can avoid the stress and expense of lengthy court battles, allowing you to move forward with your life more quickly and amicably. We strive to make the process as smooth and stress-free as possible.

What is a simple uncontested divorce?

A simple uncontested divorce is when both parties agree on all terms of the divorce, including asset/debt division, child custody, a parenting plan, child support, and spousal support (a/k/a maintenance or alimony), often allowing for a faster and less costly process than litigation. While some issues can be addressed in the uncontested divorce papers, other issues need to be resolved in a written agreement (settlement or separation agreement).  In these situations divorce mediation can often save people a lot of time and money when compared to using divorce litigators to negotiate the agreement. See the Divorce Mediation practice area.

The timeline for an uncontested divorce can vary, but it typically takes 3 to 6 months from the filing of the uncontested divorce package to the final judgment of divorce, depending on the court’s schedule and whether there are children under 18 years of age.

The Process

1. Initial Consultation

The process begins with an initial consultation where we discuss your situation, verify that both parties agree on all terms, and determine that an uncontested divorce is the right path for you.

2. Preparation of Documents

We prepare all necessary documents. Ensuring accuracy and completeness at this stage is crucial for a smooth process.

3. Review and Signing

Both parties review the prepared documents to ensure they are accurate. Once satisfied, both parties sign the documents, acknowledging their consent to the terms.

4. Filing with the Court

We file the signed documents with the appropriate court. This step starts the 3 to 6 month waiting time for the court to sign the judgment of divorce.

5. Finalization

Once the court processes your paperwork, a judge will review and approve your divorce. In most cases, no court appearance is necessary. Upon approval, the divorce is finalized, and you receive your divorce decree.
